Shipping & Returns
“Buyer” means the person who accepts a quotation of the Seller for the sale of the Goods or whose order for the Goods is accepted by the Seller.
“Goods” means the goods (including any instalment of the goods or any parts for them) which the Seller is to supply in accordance with these Conditions and any goods supplied in substitution for or in replacement of or in addition to such goods. “Seller” means BLACK CANDLES LIMITED (registered in England & Wales under number 08004469).
“Conditions” means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the Buyer and the Seller.
“Contract” means the contract for the purchase and sale of the Goods.
“Writing” includes letter, cable, facsimile transmission, email and comparable means of communication.
Any reference in these Conditions to any provision of a statute shall be construed as a reference to that provision as amended, re-enacted or extended at the relevant time.
The headings in these Conditions are for convenience only and shall not affect their interpretation.
Delivery cost is based upon the total weight of your order.
You are able to see the delivery charge which will be added to your order by viewing your shopping basket once you have placed items into it. The cost of the goods along with any delivery cost is calculated and displayed as you add items to your basket.
In order to keep delivery costs down, large or heavy orders may be split and sent as separate consignments, at no extra charge to you. Where a postage method has been selected and a more expensive method is available, we may send your order via the more expensive method, at our expense with no additional cost to you.
All of our candles are made here at Black Candles Limited and not with a third party or drop shipper. This means we are able to get your order shipped as soon as possible.
For UK Orders:
Orders under 2000g in weight (including the packaging) will be dispatched via Royal Mail 48.
Orders over 2000g (including the packaging) will usually be dispatched via Royal Mail 24 or via Courier
For UK Customers, Royal Mail 48 is usually a 2 day delivery service, Royal Mail 24 a 1-2 day delivery service. Please Note: This is the delivery estimate from the date we dispatch your order, not necessarily from the date you place your order! All delivery estimates exclude weekends)
Delivery times are estimates only and cannot be guaranteed by Black Candles Limited, especially during busy periods.
We will NOT mark packages to be left in a safe place. If you are not able to accept the package use a delivery address where somebody can. The Royal Mail will leave a card if they are unable to deliver, allowing you to collect in person or rearrange delivery.
Any dates quoted for delivery of the Goods are approximate only and the Seller shall not be liable for any delay in delivery of the Goods howsoever caused. Time for delivery shall not be of the essence unless previously agreed by the Seller in writing. The Goods may be delivered by the Seller in advance of the quoted delivery date upon giving reasonable notice to the Buyer. The Seller shall be entitled to make part delivery of the Goods at any time.
Except in respect of death or personal injury caused by the Seller’s negligence, the Seller shall not be liable to the Buyer by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract for any consequential loss or damage (whether for loss of profit or otherwise) costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of the Seller, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Buyer, except as expressly provided in these Conditions.
You can check the status of your order at any time, by going logging into your profile and clicking the Order History Button. This area will give you full details of your current and past orders with us. It will tell you, for example, if your order has been dispatched etc ...
Customs and Excise Procedures
For sales outside of the UK you may be charged import tax or import duty according to your local laws. These charges must be borne by you as we have no control over them and cannot predict what they may be. Normally, you pay these taxes to the local Postal or Delivery Service.
Under international law, you are considered to be the importer of the item and you who must comply with all laws and regulations of the country in which you are receiving the goods before you order. Customs policies can vary widely from country to country, so you should contact your local customs office if you require further information.
All our international customers should note that cross-border deliveries may be subject to opening and inspection by customs authorities. Further, we may be required to supply details about the order to customs authorities in order to facilitate customs clearance and to comply with local laws.
Generally, all customs forms for international packages require us to list the value of the contents of your order by product type.
Returns and Refunds
On receipt of your consignment please inspect contents immediately. Whilst every care is taken to ensure suitable packaging has been utilised, all observations of damage or missing items must be reported to us within fourteen days of you receiving your order. If you receive an item which is damaged please notify us by email and we will arrange a replacement.
Items found to be damaged by the customer will not be refunded.
If you wish to return an unwanted item for a refund you must notify us with fourteen days of receiving your order. Failure to do so means we are unable to offer you any refund of any kind.
Unwanted items to be returned must be sent back at your cost. Items should be returned unused, in their original packaging (unopened where possible) and should be sent via recorded post so as to be able to track the location of the items in the event of any dispute. Unwanted items to be returned must be sent back at your cost.
Refunds will be processed upon receipt of the returned item/s.
Occasionally packages are returned to us as undeliverable because they have been refused, unclaimed or the delivery address is incorrect. It is your responsibility to ensure the correct shipping address is entered and that someone is available to accept the package if required, or collect the item from the Royal Mail sorting office if necessary.
This Postage and Returns policy does not affect your statutory rights.
